Este momento maquiavélico, esta reflexión sobre el Estado que comienza con Maquiavelo, termina un poco antes de la Revolución Francesa con la última reflexión que es la de los constituyentes americanos. Desde Maquiavelo hasta los constituyentes americanos, la reflexión sobre el modelo de Estado toma forma y termina.

¿Qué pasó con la definición del estado moderno? Corresponde a los electores proponerlo, es el fin del momento maquiavélico, propondrán una visión que sintetice las definiciones anteriores.

El pensamiento de los constituyentes americanos[modifier | modifier le wikicode]

Los constituyentes americanos heredaron un rico y complejo proceso de pensamiento, y ellos mismos se enfrentaron a una serie de preguntas tratando de responder a estas preguntas inspirándose en Locke, Montesquieu y otros.

Se hicieron cuatro preguntas importantes:

  1. ¿Cómo podemos reticular, redefinir las ideas de la república y la democracia? # La pregunta es quién de Rousseau, Montesquieu, Maquiavelo tiene razón o cómo un nuevo estado que ha sido independiente por apenas 10 años en 1786 puede convertirse en un estado moderno, ¿qué tipo de estado se necesita?
  2. ¿Cómo combinar la necesaria pluralidad existente en la sociedad americana con la unidad necesaria para el buen funcionamiento de una república o estado moderno? ¿Cómo se puede enmarcar la diversidad? ¿Cómo podemos construir un estado que respete la diversidad y que al mismo tiempo sea unitario, unido y centralizado? Encontramos este problema en el billete de dólar E pluribus unum.
  3. ¿Cómo puede introducirse y hacerse operativo el principio de la soberanía del pueblo? Todos están a favor del principio de la soberanía del pueblo, todos son discípulos de Rousseau, pero todos le temen también, ¿qué hacer, cómo unirse limitando la soberanía del pueblo?
  4. ¿Qué modelo de república es deseable para lo que ahora se llama Estados Unidos de América? ¿Es una república comercial o es una república agraria compuesta por pequeños propietarios, es una república centralizada o descentralizada? ¿Es una república imperial?

Las respuestas a estas preguntas son muy completas.

Los federalistas[modifier | modifier le wikicode]

La primera observación es que cuando se sigue el razonamiento de los federalistas sobre cuál de las democracias o repúblicas es el régimen preferible, parten de la angustiosa observación de que las democracias de las antiguas ciudades estaban divididas por disputas. Para todos los federalistas sin excepción, la democracia tal como la practicaban los antiguos es simplemente impracticable, las democracias del pasado no han logrado establecer una cierta estabilidad en la política.

La segunda observación es que, por otra parte, lo que funciona es el régimen republicano: lo que permite gestionar, controlar las facciones, la inestabilidad de las antiguas ciudades puede ser contenido y transformado en el régimen republicano; en otras palabras, la democracia es el régimen del pasado, es necesario construir un nuevo tipo de república con un orden jurídico y político preciso para controlar las facciones.

Las facciones son una necesidad y un hecho ineludible, no se pueden evitar las opiniones divergentes, la cuestión no es cómo utilizarlas, sino cómo utilizarlas para que se garantice la libertad? Un régimen permite que estas facciones coexistan, que se peleen entre sí: es el régimen republicano. Sin embargo, no dice cómo puede ser detectado y cómo está estructurado.

El tercer punto es que los federalistas construyen un sistema político y jurídico en el que ninguna facción puede ganar porque es un sistema político basado en unos pocos principios clave. La pregunta es: ¿cuáles son estos principios ineludibles? Hay esencialmente tres que muestran que los constituyentes americanos son los seguidores de Rousseau, Montesquieu, Maquiavelo y un poco de Hobbes.

  • principio de representación política: básicamente contra Rousseau, los constituyentes americanos, los federalistas en particular, establecen el vínculo entre la soberanía del pueblo y la representación política. El principio de representación y la soberanía del pueblo no son incompatibles. Para los federalistas se puede afirmar que el pueblo es soberano, pero en la práctica política se puede hacer funcionar este principio de manera diferente a los atenienses o a los espartanos, somos soberanos, pero necesitamos representantes, sobre todo en un gran territorio. Desde este punto de vista, los electores americanos son seguidores de Rousseau mientras se distancian de él. El primer criterio de la república moderna es el principio de la representación política, que no es incompatible con el principio de la soberanía del pueblo.
  • Una república moderna basada en la representación y el principio de la soberanía del pueblo debe ser una república que consagre y establezca la separación de poderes: se trata de establecer poderes muy distintos mediante el establecimiento de un poder judicial extremadamente fuerte y autónomo; la Corte Suprema de los Estados Unidos ha desempeñado en la historia americana un papel esencial de árbitro, de poder por encima de los poderes.
  • La república debe ser federal: es el nacimiento del estado federal americano que debe distinguirse de la idea de confederación estatal. Un estado federal está mucho más centralizado, mientras que en una confederación estatal el poder recae en los estados contratantes, hay un desplazamiento del poder de los estados americanos a lo que se convertirá en el estado federal.

No hay una república moderna basada en la representación, la soberanía del pueblo, la separación de poderes con un poder judicial fuerte si esa república no es federal; es Montesquieu quien define la república federal.

Estos cuatro criterios representan la base de la república moderna defendida por los federalistas.

Los antifederalistas[modifier | modifier le wikicode]

Esta visión de la república de los federalistas ha sido por supuesto impugnada, los antifederalistas van a proponer una visión radicalmente diferente basada en el rechazo, en una especie de contramodelo.

La república viable no se basa en el comercio, no es imperial, no debe tener una política de poder, no debe ser comercial, no debe tener la vocación de ser un imperio.

La gran denuncia de los antifederalistas durante los debates de Filadelfia se basa en un temor muy importante, que es ver la ley de los estados unificada. Van a denunciar la visión centralizadora y unificadora de los federalistas.

En otras palabras, los antifederalistas tienen una visión mucho más particularista de la república; estas dos visiones de la república son opuestas entre sí, y muy fuertemente durante la convención de Filadelfia, los derrotados tendrán la retórica para ellos, pero no ganarán la lucha.

Otras cuestiones entre federalistas y antifederalistas son el estado centralizado frente al descentralizado, la universalización, pero también la cuestión del ejército.

Los antifederalistas defendían una concepción casi moderna del ejército, el ejército iba a ser un ejército de milicias, estamos en una visión maquiavélica. Los federalistas defenderán la idea de un ejército profesional moderno.

La república debe basarse en un ejército fuerte y permanente, capaz de defender las fronteras de esta república, que tiene vocación de conquistar grandes áreas.

Los federalistas tienen una visión permanente del ejército y quieren poner el énfasis en una marina poderosa, porque cuando tienes una flota poderosa controlas los mares y puedes proteger y expandirte.

Los federalistas buscaban establecer una república imperial moderna. Los antifederalistas reaccionaron con fuerza.

« No debéis buscar el fortalecimiento de vuestro comercio, ni convertiros en un pueblo grande y poderoso, sino asegurar la libertad; pues la libertad debe ser el objetivo esencial de vuestro gobierno. ... este nuevo poder pisoteará su libertad caída: que mis queridos americanos se cuiden del letargo fatal que ha pervertido el Universo; ¿podemos permitirnos resistir ejércitos disciplinados cuando nuestro único medio de defensa está en manos del Congreso? ...] ¿Emularemos el ejemplo de las naciones que han cambiado un gobierno modesto por uno magnífico? ¿Son estas naciones dignas de nuestra imitación? ¿Qué compensación pueden pedir por la pérdida de su libertad? Si aceptamos este gobierno consolidado, será por amor al esplendor y la grandeza de un poder formidable. De una forma u otra, tendremos un gran y poderoso Imperio; tendremos una marina, un ejército y muchas otras cosas. El debate[modifier | modifier le wikicode]

Los pensadores de esta república moderna, comercial e imperial contraatacarán, los debates con los antifederalistas serán tormentosos.

Uno de los ángulos de su ataque es que la concepción federalista de la república se basará básicamente en la redefinición de dos palabras importantes en el orden político. En otras palabras, los federalistas darán una nueva definición de la idea de constitución y pueblo.

¿Cuál es el nuevo significado dado por los federalistas?

Básicamente, la idea de constitución puede reducirse a dos significados diferentes:

  • el término constitución como los federalistas piensan que tiene un significado institucional: la constitución es en primer lugar un documento que organiza los poderes públicos, este es el significado institucional clásico que conocemos hoy en día.
  • Significado normativo de la constitución: los federalistas darán a la constitución el significado de ley suprema, ley sobre ley; la constitución en esta perspectiva federalista se define como la norma suprema. Esta es una nueva dimensión.

Antes de los federalistas americanos, la constitución tenía un solo significado entre otros, para Bodin estas son las leyes fundamentales del reino, una constitución ya no es sólo un documento, sino que los artículos de la constitución son sagrados ya que tienen una dimensión normativa.

La otra contribución es la idea del pueblo o nación americana; entre todos los desacuerdos institucionales, constitucionales, políticos, legales que tuvieron con sus oponentes antifederalistas, había de hecho una segunda diferencia esencial después del significado mismo de la palabra constitución que era la concepción de la nación americana que era extremadamente diferente.

En primer lugar, la definición de federalistas es una definición bastante clásica de la gente como cualquier persona que nació en suelo americano. La segunda dimensión de la definición del pueblo americano, las diferencias de los antifederalistas tendrán y defenderán una definición exclusiva, no todo el mundo es parte de la nación americana, incluyendo los negros, los nativos americanos y los pueblos indígenas que no se consideraban parte de la nación americana.

Los no-wasps no están incluidos para los federalistas en la nación americana; afirmar la soberanía del pueblo es algo bonito, pero si definimos el pueblo exclusivamente, las cosas son más matizadas.

Esta concepción exclusiva y limitada del pueblo americano se encuentra en la Declaración de Independencia Americana.

« […] Abandonó el gobierno de nuestro país, declarándonos fuera de su protección y haciéndonos la guerra. Ha saqueado nuestros mares, devastado nuestras costas, quemado nuestras ciudades y masacrado a nuestros ciudadanos. En este mismo momento está transportando grandes ejércitos de mercenarios extranjeros para llevar a cabo la obra de muerte, desolación y tiranía que se inició en circunstancias de crueldad y perfidia de las que sería difícil encontrar ejemplos en los siglos más bárbaros, y que son totalmente indignas del líder de una nación civilizada. Ha provocado una insurrección doméstica entre nosotros, y ha tratado de atraer a los habitantes de nuestras fronteras a los indios, esos salvajes despiadados, cuya forma conocida de hacer la guerra es masacrar todo, sin importar la edad, el sexo o la condición. »

Esta visión exclusiva de la ciudadanía americana es muy característica de los federalistas Hamilton, Jay y Madison.

No se trata de una especificidad americana, en los escritos revolucionarios franceses, la concepción definida por los revolucionarios franceses es una visión jerárquica de los pueblos europeos. Hay toda una lista de la jerarquía de los pueblos según los revolucionarios franceses: los franceses, los suizos, los ingleses, los americanos, los españoles, los rusos, los chinos, los persas. La idea de fraternidad universal transmitida por las revoluciones americana y francesa se ve socavada de hecho por una visión de la jerarquía de los pueblos que desafía.

Los federalistas defenderán una visión imperial de la república moderna. Estos son textos que sintetizan la Ilustración Europea.

« A firm Union will be of the utmost moment to the peace and liberty of the States, as a barrier against domestic faction and insurrection. It is impossible to read the history of the petty Republics of Greece and Italy, without feeling sensations of horror and disgust, at the distractions with which they were continually agitated […] »

Es evidente que las democracias del pasado no son la solución del mundo moderno; eran inestables y deben ser abandonadas.

¿Podemos, por lo tanto, encontrar un régimen que combine el orden y la libertad?

« From the disorders that disfigure the annals of those Republics, the advocates of despotism have drawn arguments, not only against the forms of Republican Government, but against the very principles of civil liberty. They have decried all free Government as inconsistent with the order of society […] »

Conocen sus clásicos:

« The science of politics, however, like most other sciences, has received great improvement. The efficacy of various principles is now well understood, which were either not known at all, or imperfectly known to the ancients. The regular distribution of power into distinct departments; the introduction of legislative balances and checks; the institution of courts composed of judges holding their offices during good behavior; the representation of the people in the legislature by deputies of their own election: these are wholly new discoveries, or have made their principal progress towards perfection in modern times. »

Las democracias del pasado ya no son imitables, son hermosos modelos. Necesitamos crear un sistema que neutralice las facciones:

« When Montesquieu recommends a small extent for republics, the standards he had in view were of dimensions far short of the limits of almost every one of these States. »

Montesquieu se equivocó al equiparar Hamilton a república y pequeño territorio, es posible equiparar gran territorio y república:

« So far are the suggestions of Montesquieu from standing in opposition to a general Union of the States, that he explicitly treats of a CONFEDERATE REPUBLIC as the expedient for extending the sphere of popular government, and reconciling the advantages of monarchy with those of republicanism. »

Para Hamilton, la república federal es el sistema que combina las ventajas de una monarquía con los beneficios de una república.

« I have thought it proper to quote at length these interesting passages, because they contain a luminous abridgment of the principal arguments in favor of the Union, and must effectually remove the false impressions which a misapplication of other parts of the work was calculated to make. They have, at the same time, an intimate connection with the more immediate design of this paper; which is, to illustrate the tendency of the Union to repress domestic faction and insurrection. »

Necesitamos encontrar un sistema que suprima, controle las insurgencias internas y externas.

« By a faction, I understand a number of citizens, whether amounting to a majority or a minority of the whole, who are united and actuated by some common impulse of passion, or of interest, adverse to the rights of other citizens, or to the permanent and aggregate interests of the community. »

Es la definición de la facción que necesita ser neutralizada, el poder maligno de las facciones necesita ser combatido. La explicación se detalla a continuación:

« The inference to which we are brought is, that the causes of faction cannot be removed; and that relief is only to be sought in the means of controlling its effects. »

Los federalistas tienen una concepción algo negra de la naturaleza humana. Tanto los federalistas como los antifederalistas desconfían de los vicios humanos, el hombre es un ser corruptible, están obsesionados con la capacidad del hombre para corromperse a sí mismo.

No son como sus predecesores interesados en construir una reflexión sobre el hombre, lo importante es corregir los efectos, hay que aceptar que el hombre no es necesariamente un "santo" y la cuestión es cómo corregir los efectos de tal hallazgo.

Para Madison, el poder detiene el poder, es en el nombre de este adagio que las facciones se detendrán:

« By what means is this object attainable? Evidently by one of two only. Either the existence of the same passion or interest in a majority, at the same time, must be prevented; or the majority, having such coexistent passion or interest, must be rendered, by their number and local situation, unable to concert and carry into effect schemes of oppression. If the impulse and the opportunity be suffered to coincide, we well know that neither moral nor religious motives can be relied on as an adequate control […] »

Las pasiones humanas deben ser contenidas, y para ello deben ser controladas.

« A Republic, by which I mean a Government in which the scheme of representation takes place, opens a different prospect, and promises the cure for which we are seeking. Let us examine the points in which it varies from pure Democracy, and we shall comprehend both the nature of the cure, and the efficacy which it must derive from the Union.

The two great points of difference, between a Democracy and a Republic, are, first, the delegation of the Government, in the latter, to a small number of citizens elected by the rest: Secondly, the greater number of citizens, and greater sphere of country, over which the latter may be extended. »

El principio de representación se afirma en The Federalist XI :

« There are appearances to authorize a supposition, that the adventurous spirit, which distinguishes the commercial character of America, has already excited uneasy sensations in several of the maritime powers of Europe […] They foresee the dangers, that may threaten their American dominions from the neighborhood of States, which have all the dispositions, and would possess all the means, requisite to the creation of a powerful marine [...]A further resource for influencing the conduct of European nations towards us, in this respect, would arise from the establishment of a Fœderal navy. There can be no doubt, that the continuance of the Union […]Our position is, in this respect, a most commanding one. And if, to this consideration we add that of the usefulness of supplies from this country, in the prosecution of military operations in the West Indies, it will readily be perceived, that a situation so favorable would enable us to bargain with great advantage for commercial privileges. A price would be set, not only upon our friendship, but upon our neutrality. By a steady adherence to the Union, we may hope, erelong, to become the Arbiter of Europe in America; and to be able to incline the balance of European competitions in this part of the world, as our interest may dictate. »

Piensa que una marina fuerte capaz de imponer su punto de vista y el tema de la república imperial se extiende.

« I shall briefly observe, that our situation invites, and our interests prompt us, to aim at an ascendant in the system of American affairs. The world maypolitically, as well as geographically, be divided into four parts, each having a distinct set of interests. Unhappily for the other three, Europe, by her arms and by her negotiations, by force and by fraud, has, in different degrees, extended her dominion over them all. Africa, Asia, and America, have successively felt her domination. The superiority she has long maintained has tempted her to plume herself as the Mistress of the World, and to consider the rest of mankind as created for her benefit. El régimen republicano, el estado que los Estados Unidos llaman la república moderna puede existir en un gran territorio, se trata de encontrar un equilibrio entre un estado federal y el poder de los estados. Esta división de poderes no se decidió hasta 1806 en un famoso fallo americano que dio al estado federal preeminencia sobre el estado confederado.

« Happily for America, happily we trust for the whole human race, they pursued a new and more noble course. They accomplished a revolution which has no parallel in the annals of human society. They reared the fabrics of Governments which have no model on the face of the globe. They formed the design of a great Confederacy, which it is incumbent on their successors to improve and perpetuate. If their works betray imperfections, we wonder at the fewness of them. If they erred most in the structure of the Union, this was the work most difficult to be executed. »

Este capítulo consagra la separación de poderes, lo cual se establece muy claramente.

« It is equally evident, that the members of each department should be as little dependent as possible on those of the others, for the emoluments annexed to their offices. Were the Executive magistrate, or the Judges, not independent of the Legislature in this particular, their independence in every other would be merely nominal. »

Este texto termina el esquema de poder. Una frase va a ser la gran respuesta a todos los principios que hemos visto, los federalistas nos han descrito la visión de la república comercial moderna con una visión imperial.

Para los antifederalistas, lo que se está construyendo no es una república moderna, sino un imperio; los federalistas quisieron sintetizar el modelo, pero no en el buen sentido, trataron de fundar una república que se convierta en un imperio.

¿Qué pasa después de la Revolución Americana y la Revolución Francesa?[modifier | modifier le wikicode]

Después de la revolución industrial, en el siglo XIX, el pensamiento político dio lugar básicamente a otro debate; ya no se discute la definición del Estado, ya no se discute el debate sobre la relación entre el Estado y los individuos como lo habían hecho Montesquieu y Locke; la pregunta que surge es: ¿qué Estado queremos? ¿Debería el Estado ser un regulador?

Si el Estado sigue siendo un simple regulador que garantiza la seguridad pública o si se convierte en el protector más débil debido a que el siglo XIX la revolución industrial y abrió las puertas a la forma de gobernar la miseria, los trabajadores que están entrando en los Estados europeos.

¿Cómo podemos hacer del Estado un Estado que de alguna manera preserve la igualdad y la fraternidad, pero también una forma de justicia y equidad en un mundo transformado por la revolución industrial?

Si la filosofía de Mill y la filosofía contemporánea permanecen atentas a los problemas planteados por Mill, estas siguen siendo las preguntas que los filósofos se hacen hoy en día; en otras palabras, el Estado contemporáneo está siendo repensado a la luz de tres preguntas :

  1. ¿El estado de bienestar soñado por los revolucionarios americanos y franceses aún tiene futuro?
  2. ¿Está el Estado adaptado al fenómeno de la globalización?
  3. ¿No socava la globalización del comercio la visión del Estado-nación centrada en la política, centrada en una visión interna del derecho, en una visión de la soberanía que es esencialmente interna y no muy abierta al mundo?

La mala noticia es que estas tres grandes preguntas aún no han sido respondidas, la buena noticia es que tenemos que tomar el relevo y reflexionar sobre la historia de este concepto de Estado, que se originó en el siglo XVII, recordando que no podemos saber a dónde vamos si no sabemos de dónde venimos.
